Owner financing on raw land: what to check before you sign

When there is no lender, nobody is checking title but you. That is the entire trade you are making.

Owner financing is common on rural land because banks are reluctant to lend on parcels with no structure. The appeal is obvious: low down payment, no underwriting, fast close. The cost is less obvious — you have removed the one party whose job was to verify the seller actually owns what they are selling.

Confirm the seller's title independently

Pull the deed chain yourself or pay someone to. You are looking for the seller's name on the last recorded deed, no open liens, no unresolved estate, and no prior contract for deed on the same parcel. A title company will do this for a few hundred dollars even when no lender requires it, and it is the cheapest insurance in the transaction.

Deed at closing vs. contract for deed

There is a large legal difference between receiving the deed at closing with a recorded mortgage or deed of trust against it, and a contract for deed where the seller holds title until the final payment. In the second structure, in many states a late payment can cost you both the parcel and everything you have already paid. Prefer the first structure. If the seller insists on the second, understand your state's forfeiture rules before signing.

Read the terms for these five items

  • Balloon payment: is the full remaining balance due in 3 or 5 years, and can you refinance raw land by then?
  • Prepayment penalty: can you pay it off early without a fee?
  • Default and cure period: how many days late before remedies start?
  • Who pays property taxes and who verifies they were paid.
  • Recording: is the instrument recorded at the county, or is it a handshake in a drawer?

Diligence does not change because financing did

Access, zoning, flood, perc and utilities matter exactly as much on an owner-financed parcel — arguably more, because you cannot lean on an appraiser or a lender's requirements to catch a problem for you. Run the same checks you would run on a cash purchase, then run the financing terms on top.
